Important to Read:
Regardless of the above, any provision in these General Terms
and Conditions that says that it is operational by Your use of the Website
shall govern Your use of the Website, and you must not use the Website if you
do not agree to such terms.
At Gallivant Journeys, we hold a strong belief in delivering
genuine and truthful service to our clientele. You can share any queries you
have with us by telephone or write to us. We will be more than happy to respond
to your issues or provide any explanations you may require.
EXCLUSIONS
Payment :
We provide a plethora of payment options to facilitate the easy
and streamlined booking of any tour, package, or service. At Gallivant
Journeys, the various payment options available are NEFT, RTGS, IMPS, and
popular user-friendly wallets such as BHIM, PhonePe, Gpay, PayTM, or any UPI
ID. “Go Digital”
Any cash payment in INR (Indian Rupees) should be as per the
guidelines of the GOI (Government of India), accompanied by a PAN Card. It
should be noted that we don’t accept outstation cheques.
Payment
Plan : At the time of booking, minimum
payment of 40% of the total holiday price needs to be done + the entire price
for Air Tickets Per Person needs to be paid.

Remaining Payment for the tour is
due 60 days before departure.
·
During the festive or peak season
or holiday time, the remaining payment must be done 90 days prior to the start
of the tour, for this we will notify you
in advance.
1. The booking will be processed after receiving receipt of the
payment and the required documents (as specified below)
o
For Indian
Travelers - Passport, Pan Card, Aadhar Card and signed tour form.
o
For Non - Indian
Travelers - Passport, Visa, Travel Insurance and signed tour form.
2. As we receive the
above-mentioned documents, we will notify you of the booking status of your
chosen tour package within 3 working days.
3. As per the guidelines
mentioned above, full payment should be made accordingly. If the client doesn’t
comply with this, the company has the right to cancel the client’s
tour/booking, leading to the forfeiture of the deposit, and to apply and
recover the specified cancellation fees.
4. We require the
soft/hard copies of the Visa & Flight tickets if the same has been done by
the clients on their own.
5. If the Clients / guest
has booked the tour online, the guest needs to reconfirm and authenticate the
information provided at the time of online booking. The company reserves the right
to cancel the booking and forfeit the amount paid in case of any misleading
information provided by the guest.
6. The initial
payment made during registration is non-refundable & interest-free. The
cancellation and refund policy will determine the credibility of the refund.
The amount of registration will depend on the tour you book. The tours with
cruise or air travel have higher registration amounts than the other tours. The
registration payment guarantees a spot on the tour but doesn’t grant the
facility of visa, travel tickets, hotel stays etc. until the full payment is made
by the client. As per the payment instructions mentioned on www.gallivantjourneys.com, the whole payment must get settled 60 days before the
commencement of the tour. If the booking is made within 60 days of the
departure of the tour, then the payment should be made upfront. During any
aspect, if the amount is not fully paid during registration, then the leftover
amount should be paid within 3 days of booking; else the booking will be
cancelled.
Payment Policy for Tour or Tour’s Foreign Exchange:
5. The Forex(‘FX’) payment is a part of the BTQ
of the Indian passenger. What is BTQ? BTQ (Basic Travel Quota) is a
scheme under the Liberalized Remittance Scheme (LRS) of the Reserve
Bank of India (RBI) that allows Indian residents to purchase foreign
exchange for personal travel abroad.
6. For
packages solely involving foreign exchange (FX), the initial deposit collected
in Indian Rupees (INR) during booking will be adjusted against the outstanding
FX amount upon final FX payment.
Charges pertaining to
Cancellation/Changes
Except
for any particular case outlined by a specific clause, any reimbursement due to
any modification or cancellation of a Tour Contract by You (traveller),
encompassing scenarios like cancellations or changes due to any unavoidable events,
will be subject to the subsequent fees:
Cancellation
fees or change fees:
Cancellation
will be applied as follows :
1.
61+ days before commencement of
the tour: Loss of deposit equivalent to 40% of the total cost along with flight
cancellation charges. Incase of 91+ days, advance payment the cancellation will
also become 91+ days before commencement of the tour.
2.
60-31 days before commencement of
the tour: Loss of 55% of the tour cost along with flight cancellation charges
3.
Less than 30 days before tour
commencement: Loss of 100% of the tour cost
Remark for
Cancellation:
1.
If you cancel/shorten or unuse
any portion of the tour after it begins (including the tour’s start date), the
full tour price will be charged
2.
If the company books
international flights for the tour and the same gets cancelled or changed,
there will be different T&C for those and the associated fees will be borne
by the client itself.
3.
There will be no refund for any
No Show and unused service.
4.
Strictly NO Refund for un-utilized services once booking is confirmed. We
are not responsible for any Airline charge such as Airfare, changes,
cancellation in any circumstance chance.
5.
There will be no refund in any
scenario of Visa rejection.
6.
If there is any change in the
program after the booking finalization, it may attract a financial supplement.
7.
The mentioned cancellation fees
also include certain overhead costs incurred for preparing and operating the
tour.
8.
Gallivant Journeys is not
obligated to give any breakdown of the tour price or cancellation fees.
9.
Refunds due to cancellation will
be proceeded within 20 working days upon receiving the final confirmation of
cancellation in written form i.e. either a mail to ops@gallivantjourneys.com
or a Whatsapp message to +91 81188 12073. The date on which the email is sent
will be considered the final date of cancellation and the cancellation charges
will be levied accordingly.
10.
The refund payment will be in the
form of either an A/C payee cheque, Online Transfer (Domestic – NEFT or RTGS)
and (International – wire transfer, international remittance charges will be
borne by the client i.e. Traveler/ payer for the tour/ booker of the tour.
11.
Gallivant Journeys isn’t liable
to pay any interest on the tour amount.
12.
Gallivant Journeys holds no
responsibility for any additional expense related to the tour made by the guest
/ clients on their own.
13.
If a guest wants to choose a
different tour, it should be discussed with their travel advisor. If the cost
for this new tour is different from the existing tour then the guest either has
to pay for the same or will get a refund.
14.
If you request any modification
to the tour like a change of dates or any other aspect and the company agrees, this
will be considered as a tour change and cancellation rules will apply. This is
specifically applicable to the portion of the tour that had to be cancelled due
to the change.
15.
After getting the confirmation of
the tour, the tour is not allowed to be transferred to any other person.
16.
If the guest is not able to
provide the required mandated documents or doesn’t submit them within the
stipulated time frame, the booking will be annulled, and cancellation charges
will be applied.
17.
If the tour gets
cancelled due to issues with the passport, the guest would be responsible to
cover the cancellation charges. For certain tours, we will facilitate to the
collection of the passport and submit it to private entities, consulates, or
embassies. However, it would not be accountable and is not liable to provide
any sort of compensation or refund if the passport is lost or damaged.
18.
After the final cancellation of
the booking, it can’t be reinstated. Any reversal booking or rebooking will be
considered as a new reservation and all charges will be applied like a new
booking.

Visa Delay or Rejection Policy
All clients booking international tours with Gallivant
Journeys must have a valid visa. Visa approval or rejection is solely at
the discretion of the consulate or relevant authorities. Gallivant Journeys
is not responsible for visa decisions, even if all required documents are
submitted. The company only facilitates the application process and has no
influence over consulate decisions.
Clients must submit all required documents on time;
delays or incomplete submissions may result in visa rejection. The consulate
may also request a personal interview at its discretion. If a visa is denied
and the client reapplies, all reapplication fees must be borne by the client,
and no claims can be made against Gallivant Journeys.
Important
Notes:
Since COVID-19 is no longer a major travel concern,
the policy needs to be updated or removed. Most governments and airlines
no longer enforce COVID-specific safety norms, and travel providers do
not cancel bookings based on COVID-related symptoms anymore.
Here’s how the policy can be modified to
reflect the current travel landscape while maintaining general health &
safety conditions:
Health & Safety Policy
Clients must acknowledge that travel service
providers may cancel or modify bookings in the following situations:
Gallivant Journeys holds no liability in such cases. Refunds or rescheduling, if
applicable, will be subject to the company's terms and conditions.
Furthermore, travelers must comply with any updated
health and safety regulations set by authorities. Failure to adhere to such
regulations, resulting in travel refusal, will be the traveler's
responsibility, and Gallivant Journeys will not be liable.
1.
Due to
Circumstances Beyond the Control of the Company
1.
The company will not be accountable or
will consider as violating the Tour Contract if it fails to meet any part of
the contract due to a circumstance which was beyond the Company’s reasonable
control (“Force Majeure Event”). These possible instances may be, but are not
limited to natural disasters like floods, earthquakes, tsunamis, fires, and
explosions; government actions: invasion, war, hostilities, terrorist
activities; civil disturbances, national emergencies, epidemics, uprisings,
revolutions, labour strikes, breakdown of power supply or communication; or any
delay by supplier including situation in which the supplier get insolvent, get
bankrupt, or can’t meet their financial obligations, or similar proceedings.
2. To eliminate any occurrence of doubt:
a Force Majeure Event also consists of the following events: Any emergency of a
pandemic, epidemic, or prevalent disease which can be fatal for human life, as
determined by either local regulatory bodies, state government, the U.S.
federal government, WHO (World Health Organization), or the US Centers for
Disease Control (CDC). A few typical examples are coronavirus, pneumonia
(atypical), avian influenza, and SARS.
2.
Compliance with any travel restrictions,
warnings, or advisories related to such situations issued by local, city,
county, or state governmental entities, the U.S. federal government, the World
Health Organization (WHO), or the U.S. Centers for Disease Control (CDC).
3.
Quarantine or similar measures
implemented by regulatory bodies and authorities to prevent the spread of any
communicable disease.
4.
Unavailability of resources, information,
or services due to the above-mentioned situations. It includes the government
shutdowns, lockdowns, or unavailability of any third-party service or
information relied upon by the Company to fulfil its obligations under the Tour
Contract.
5.
If any Force Majeure Event occurs, then
the company can excise its right to cancel the entire tour and terminate the
Tour Contract. In such instances of Force Majeure Events, the company will not
be accountable and liable for any refund, compensation, interest, or damages.
The client will be responsible for the costs associated with utilized services
and products up until the termination date. In case, the Force Majeure Event
occurs after the beginning of the tour, and the tour gets cancelled due to
this, then the company will make all efforts to return you to your original
departure point if there is a return journey in the Tour Contract. However, any
extra expense for the return journey will be borne by the client only.
3.
Due to guest not accepting the changes in the
tour
Gallivant Journey has complete authority of making changes to
the tour by adding/deleting/exchanging
the sightseeing places or any other service for the betterment of the itinerary
and on this basis, the guest cannot withdraw from the tour.
1. In such a scenario, if it requires
paying any extra charges for the sightseeing or any other service, then the
guest has to bear the charges.
2. If the guest is not willing for
accepting these changes, then the guest will have to cancel the tour and the
cancellation charges will be levied as per the Cancellation Policy.

Due to the non-payment of partial/full price:
5. Due to guest being
absent (not present) on the first day of the tour:
1.
If the guest got
absent on the first day of the tour, it will be regarded as a “No Show” and
will lead to cancellation with no eligibility for a refund.
2. All services will get cancelled, resulting in a 100%
cancellation fee unless the guests inform Gallivant Journeys that they will
join the tour later at their additional expense.
6. Due to discontinuation from the ongoing tour:
1.
For any reason, if
the guest decides to terminate or discontinue the tour, it will be considered
cancelled without any refund.
2. Gallivant Journey’s team will assist the guest in arranging
necessary services, but the guest is liable to immediately prepay all
associated expenses.
7. Due to a single (solo) guest sharing a room with another
guest, cancels the tour:
1.
For solo
travellers, it is advisable to opt for
specialized tours like Women's Special, Seniors Special, Adventure Special,
etc., where Gallivant Journey ensures a room partner, helping the guest avoid
the single occupancy fee.
2. If a single guest is travelling alone on a regular tour, they
will be charged for single occupancy. However, if they find a room partner and
share a twin/double room for the entire tour duration, the single occupancy fee
will be reimbursed
within 10 working days after the tour
concludes. No reimbursement of the single occupancy fee is applicable in case
one of the room-sharing partners cancels.
The traveller (s) should agree to indemnify and hold harmless
travel company, its employees, staff, directors, agents, managers, and other
entities (collectively, the “Indemnified Parties”) from and against any losses,
damages, liabilities, deficiencies, claims, actions, settlements, expenses
(including, without limitation, reasonable attorneys' fees and costs) arising
out of or in connection with Traveler's participation in the Travel Program,
including, without limitation, any claims arising from Traveler's negligence,
willful misconduct, or breach of this Agreement.
This indemnification will survive the Agreement termination. It
is also in addition to any other rights or remedies that the Indemnified
Parties may have at law or in equity.
By agreeing to this agreement, the traveller is giving consent
that the Indemnified Parties have relied on Traveller’s agreement to indemnify
them in entering into this Agreement.
This indemnification is intended to be a complete and exclusive
statement of the obligations of Traveler to indemnify the Indemnified Parties
and supersedes any and all prior or contemporaneous agreements,
representations, or understandings, whether written or oral.
This indemnification shall be binding upon and inure to the
benefit of the Indemnified Parties and their respective successors and assigns.
This is just an example, and the specific terms of an
indemnification clause will vary depending on the specific circumstances. It is
important to consult with an attorney to ensure that the indemnification clause
is tailored to your specific needs.
Here are some additional things to keep in mind when drafting an
indemnification clause:
Be sure to define the terms "indemnify" and "hold
harmless."
Specify the types of losses that will be covered by the
indemnification.
Identify the parties who will be indemnified.
Specify whether the indemnification is mutual or one-way.
State whether the indemnification will survive termination of
the agreement.
Advise the parties of their right to seek independent legal
advice.
By carefully drafting an indemnification clause, you can help to
protect your travel company from liability in the event of a claim.
Documents required for an international
You will carry the responsibility of ensuring that your passport
is genuine & valid and meet all the criterion of international travel. The
entities of Gallivant Journey including officers, staff, employees, directors,
agents, etc. will not be held responsible if your passport is deemed ineligible
during entry or exit before or during your international travel.
Here are some important guidelines for
your passport:
Ø Passport must have a minimum validity of 180 days from the
return date of the tour
Ø Handwritten passports will be invalid
Ø There must be a barcode in the passport
Ø The passport pages should not be torn, damaged or tampered with
Ø The name on the passport should exactly match the name on other
documents provided for visa application
Ø Passport must have last page available even after the
immigration stamp of the travelling country.
Visas : VISA
stands for “Visitor’s International Stay Admission” is a permission given by
the immigration authorities of a country to the foreign individuals. This
permission allows these individuals to enter, stay, and exit that country for a
stipulated period of time. The permission is mostly in the form of a paper
document or stamp/sticked placed in the individual’s passport.
We at Gallivant Journeys assist or help in the procurement of
the visa but doesn’t have any influential power over approval or rejection of
visa. The travellers must ensure that they possess valid visas before joining a
tour. Gallivant Journey helps the guests by facilitating in preparing visa
documents, submission, and collection of passports from consulates. Some
consulates send passports directly to the guest’s address.
You must make yourself acquainted with all the required facts
and specifics regarding visa documents requirements along with the rules &
regulations of travelling in your desired location country. You would be
responsible to get your visa. However, in certain situations, Gallivant Journey
may assist in procuring the visa for you, subject to company approval. The visa
procurement expense is not covered within the Tour booking price mentioned in
any proposal provided by the company.
The Visa consulate may ask for additional details during the
visa process or can also conduct a personal interview, even after the
submission of all documents. The decision of granting a visa lies only with the
consulate and Gallivant Journeys can’t influence this decision. The guests
can’t hold Gallivant Journeys responsible for visa rejection.
After receiving the passport, the guests must carefully go
through the visa copy or stamp to check if there are any errors or
discrepancies in personal details, dates, information, stay duration (in align
with the tour itinerary). If there is any error, you must inform the Gallivant
Journeys promptly. We will try to correct such errors through the consulate, we
can’t guarantee that these errors will get resolved timely or take
responsibility of the resulting consequences.
For European Schengen visas, the complete tour payment should be
done before beginning the visa application process. If the payment is done in
parts, the guests should maintain a sufficient bank balance equivalent to the
total tour price for at least six months.
For some countries, if the valid visa is in the old passport,
then the guests must bring both old and new passports in the tour. In some
cases, it is required to transfer a valid visa from old to new passport that
may incur some additional costs.
If the guests already posses a valid visa for the tour duration
or want to manage the visa on their own, they should inform Gallivant Journeys
during booking for visa fee reduction.
The guests will be responsible to submit the visa documents to
Gallivant Journeys in advance. However, due to varying consulate processing
times and high demand, visa processing might take longer than expected. Even if
documents are submitted early, visas could still be delayed, and cancellation
charges may apply if the guest can't join the tour.
Guests working in high-security institutions should book as
early as possible to avoid any delay in visa process as it will take more than
average processing time. Gallivant Journeys is not responsible for delays or
denials of visas in such cases.
If a guest raises a dispute against the consulate or embassy and
seeks legal action, then Gallivant Journey will neither be involved nor
represent the guest.
If visa fees, VFS charges, or service charges increase between
tour launch and visa application, guests are responsible for covering the
additional costs. If for any reason, additional visas beyond those included in
the tour price might be required. In such cases, guests are responsible for the
extra visa costs.
Documents
required for a domestic tour:
The guest must possess valid government ID proof for a domestic
tour booking. As per RBI regulations and instructions, the PAN Card submission
for both domestic and international tours is mandatory. It will be the complete
responsibility of the guest to provide, submit and hold valid travel documents
including air tickets, insurance, any medical or legal certificate, etc.
The photo identification should also be carried by the guests
which includes Aadhar Card, Voter ID card, PAN Card, and Driving license and
students should also carry school/college ID card.
These photo identifications may be required at airports, rail
stations, certain sightseeing places, safari parks, border area locations, etc.
Important
Notes must be followed while traveling with Gallivant Journeys.
v Tour package prices are quoted
are based on Per Person until specifically mentioned in the proposal.
v Price
may change depending upon the flight (once confirmed then there will not be any
change)
v Currency
conversions are mentioned in the proposal, if not then you can always ask for
the same.
v Program
flow can change with your permission only for your convenience and availability
v Standard Check-in time at
hotels is 1500hrs while the Standard Check-out time is 11 am. Please be
reminded that all special requests like early check-in, smoking, nonsmoking,
views, floors, king, twin, adjoining and/or interconnecting rooms are strictly
subject to availability upon arrival and same cannot be guaranteed prior.
v Hotels or similar hotels
will be provided as mentioned in the
tour cost – until confirmed
v Should the period of
travel, or the number of participants, or the type of accommodation, or the
type of transport or the duration of the trip, change the quote will be adjusted
accordingly. Above rates are not applicable for meetings, conference / seminar
and banquet groups. The above cost does not include any kind of surcharge if
applicable during the given travel period.
v
When Transport is on SIC basis which is
sharing basis then you always need to report 15 mins prior of the pick up time
as the transport will not wait as the convenience of on board participants or
passenger is of utmost importance. On SIC pick up buffer time is 30 mins, as
the vehicle will be picking up other clients from different locations.
v
When Transport is on Private basis which
is booked for your tour as per your tour itinerary; this means guest will not share vehicle with any other group passengers. even then you need to report as per the
prefixed time so that the driver doesn’t have to wait unnecessarily. Driver will wait max 30 min at Airport upon arrival & max 10
min for all other services. And private transport doesn’t mean the vehicle is on
disposal (For any additional service
guest will have to pay extra.), if it is on disposal then it will be mentioned in
your tour inclusions. And disposal is referred as starting time (which cannot be
before 0800 am) till 2130 hrs which is 930 pm. 10 hrs is the maximum time limit
for disposal. Looking into driver’s health and your safety.

Train or Flight or cruise details and
timings may change depending upon the time of confirmation.

Train or Flight or cruise details and
timings can change even after the confirmation as these are public transport
and their operation is their own discretion.
v
Driving time between one point to
another may change depending upon the weather & traffic
v
Transit times between regions indicated
in the itinerary are dependent on road and prevailling weather conditions. As
such, they may vary.
v
Please be advised that the use of
Unmanned Aerial Vehicles (Drones) is allowed only after obtaining permit from
the relevant authorities.
v Complaints procedure:
Gallivant Journeys will act as an intermediary between the clients and other
service suppliers related to the tour, in the event of any complaint. Complaint
must be in writing and within 10 days of return to clients’ original destination.
v In case either party
suffers force majeure circumstances (that are unforeseen, inevitable and
uncontrollable), such as strikes, closing of frontiers, ports and airports, bad
weather, delays in departures and arrivals of the means of transportation,
accidents and all services provided by a third Party, as a result of which the
obligations under the present agreement cannot be fulfilled the parties shall
be exonerated from their obligations without having to pay compensation for the
damage caused to the other party.

Rates are subject to change without
prior notice, Quotes may change without prior notice, as per Hotel policy, in
case the booking has not been reconfirmed by us in writing. Please be informed
that we are providing our best rate but we reserve rights to change any rate
without any prior notice and we are not liable to accept any claim. This is
just a quotation no service has been blocked, hence all services are subject to
availability. (we request you to book at earliest so that we can process the
booking and try to get you the committed services) if not available will
advise you similar category, in case there is a variation in hotels / room
category difference will be supplement. The rooms & rates are subject to
availability at the time of booking / confirmation. We may have to reroute the
itinerary or accommodate in similar
lodges in case of non-availability. Hotel, Sightseeing, Meals, Transfers
rate might change without any prior notice until & unless it been booked/
confirmed from your end. Even after booking confirmation if the any prices
change happens from the airlines, airport port authority, monument or park
entrance fees same will be pass on to you.
This is beyond our control and any increase levied will be passed to
you.
Note : "All disputes arising out of or in connection with
the services provided by Gallivant Journeys, a division of Sarveshwar Atithya
Private Limited, shall be subject to the exclusive jurisdiction of the courts
in Jaipur, India.
